Whenever I've installed Scrivener (which is frequently, as I've participated in the betas since Dec 2010), it's always created an icon on my desktop without asking me. It's a minor irritation, but yeah. There should be an option in the installer to create one or not.
This happened to me too. I assumed it was because I tried to install the beta on the 15th of June (EST), when its release date was the 16th. I just moved my clock forward a day and it was fine (I've since moved it back).
I think I misinterpreted what specifically you meant. I interpreted 'Have it both ways' as more of a general statement than a reference specifically to the red x.
